03/02/2010

Austin, TX-A Friday morning, January 15, 2010 school bus collision in South Austin hospitalized a mother and her infant child. Highly regarded Texas automobile accident lawyer, Amy K. Witherite, reports the crash occurred around 7:15 a.m., just a block away from Casey Elementary School, as reported by KVUE.com, an ABC affiliate.

According to police officials and witnesses, a school bus was making a left turn from Slaughter Lane onto Texas Oaks Drive, at the same time as a small Kia was traveling westbound on Slaughter Lane. The school bus and the Kia collided in the intersection as a result. Witnesses to the wreck reported that the Kia had a green light when the two vehicles collided. The impact of the collision was so forceful that it pushed the entire front end of the car underneath the bus. The 26 students who were on the AISD school bus at the time were not injured in the collision. Paramedics extracted the driver of the Kia, a 21-year-old female, from the wreckage after 30 minutes of cutting at the twisted metal. She was taken to University Medical Center Brackenridge, and her infant child was taken to Dell Children's Medical Center for treatment. Their injuries were described as "potentially critical but not life threatening." Police officials are conducting a full investigation into the two-vehicle crash.

Van Alstyne Police reported that first wrong-way crash occurred around 7:51 while a white female was driving a southbound SUV in the northbound lane of Highway 75 at County Line Road. Responding emergency medical services rushed both female drivers to Wilson N. Jones Medical Center in Sherman in critical condition. Police officials reported that the wrong-way driver was first been spotted in Sherman. Alcohol is suspected to be a factor in the wreck.

The second wrong-way crash occurred just over an hour after the initial crash, which left one person dead. Bobbi Lalonde, 44, was reportedly traveling southbound in the northbound lane of Highway 75 near Farmington Road in her Mazda pickup truck. The Mazda pickup then hit a Dodge pickup truck in the northbound lanes. The driver of the Dodge reportedly saw the Mazda and tried to swerve out of the way, but the Mazda still managed to clip the Dodge. A Garland resident was killed in the wreck; their identity is currently being withheld, pending family notification.
01/07/2010

Dallas, TX-A high-speed New Years Day crash tragically ended the lives of three teenagers, when their vehicle violently slammed into a guard rail on Loop 288. Leading Dallas, Texas automobile accident attorney, Amy K. Witherite, reports the teens were traveling around 78 mph when the passenger side of the vehicle crashed into the guardrail shortly before midnight, which seriously injured four other occupants as well.

According to the information provided by the Star-Telegram and the Texas Department of Public Safety (DPS), a trooper clocked the Ford sedan the teens were traveling in at 78 mph, on Friday, January 1, 2010. Before the trooper could turn his cruiser around and pursue the speeding car, the sedan smacked into the guardrail on North Loop 288 in Denton. Two of the six teenagers traveling in the car, Adrian Alvarez, 18, and Fernando Cuevas, 19, died on impact when they were thrown from the vehicle during the violent collision.

The Tarrant County medical examiners office reported Cuevas died from blunt force trauma to the head; it is unknown what Alvarez's cause of death was. The two teens were pronounced dead at the scene of the horrific crash by responding rescue teams. Another teen, Jose Ramos, 16, was rushed to a hospital by a helicopter, but unfortunately died from his injuries shortly after. The driver and two other passengers, a male and two females, were rushed to area hospitals for treatment of their serious injuries.

12/30/2009

Dallas, TX-Road construction often causes delays, winding stretches, and traffic, but most of all they are creating deadly hazards for motorists across the United States. Leading personal injury accident lawyer, Amy K. Witherite, reports that over the last five years highway construction zones have injured at least 200,00 people and led to 4,700 fatalities, which accounts for over two a day, , as reported by the Dallas Morning News.

An easily corrected construction hazard, pavement-edge drop-offs, have contributed to the deaths of 160 people, and injured 11,000 others every year. On September 15, 2005, Bryan Lee, 26, was on his way to work, while traveling on FM51 west of Forth Worth, when he came around a curve in the road and the wheels of his motorcycle slid off the asphalt edge. Contractors, who didn't finish the roadway, just two days before Lee had his accident, left the drop-off in the asphalt there. The pavement contractors reportedly did not have the equipment to finish the road, which left a steep drop-off in the asphalt that continued for miles, and didn't plan to finish the road for a few days. Lee fell from his motorcycle and was struck by a pickup truck.

Construction zones produce dozens of hazards like concrete barriers in the wrong position, old lane markings, lack of warning signs, and unfortunately there is a lack of regulations that mandate safety measures to be implemented. Contractors often face fines when guidelines are violated, or they are fined because of ignorance, carelessness, or to save money. The problem is that contractors continuously are being hired, and the dangerous and often fatal practices stand uncorrected.

Top personal injury attorney, Amy K. Witherite, maintains when motorists are injured or even die because of the negligence of road construction contractors who leave road construction incomplete and in a dangerous and hazardous condition, you may have a personal injury claim in the state of Texas. If you or someone you love has been injured or killed because of a contractor's carelessness you may be entitled to compensation for your injuries and damages. Contacting a Dallas personal injury lawyer who is experienced with personal injury accident claims may help you recover any damages you maybe entitled to.

The Texas Department of Public Safety (DPS) stated the teen's vehicle, a Pontiac, was traveling northbound on the two-lane roadway, when the vehicle suddenly started to swerve back and forth, and then slid sideways into a Nissan.
12/21/2009

The family of a fatal truck accident that took place on the Dallas North Tollway is suing both the driver and the North Texas Tollway Authority (NTTA) for the death of their loved one, William "Billy" Bond.

The driver was following too closely to another vehicle when he lost control of his truck and hit a median, causing a sizeable piece of concrete to break apart and crash through the windshield of Bond's car, killing him instantly.

As per Linda Turly, the Bond's family attorney, the NTTA was also named in the lawsuit, as well as other companies who did engineering, construction or maintenance on the tollway.

The driver of the truck, Christopher Spicer, 44, was indicted for criminally negligent homicide, a state jail felony that carries a maximum penalty of two years.

The family's attorney says her clients are concerned about aggressive driving as well as safely designed and well-maintained roads. She added that the driver's failure to drive safely combined with an improperly maintained tollway led to Bond's death.

"You can't have chunks of concrete flying through the air when a car hits a median," Turley said. "The medians are supposed to prevent cars from entering the opposite lanes but they are supposed to be done safely."

Turley said the destroyed median that caused Bond's death has only been patched but not replaced.

Bond's family does not ask for a specified dollar amount, according to a copy of the lawsuit.

A crew of workers was reportedly attempting to restart a boiler at the Valero refinery facility, which went offline early that day, when the deadly explosion occurred. The violent explosion fatally injured instrumental and electrical operator, Tommy Mannis, 40, of Alvin, and injured an unidentified Valero employee, and a contract worker. The unidentified Valero employee was rushed by emergency medical service (EMS) teams to Galveston area hospital, while the other worker was taken to a Texas City Hospital for treatment. Their injuries and current state of condition were not reported. The boiler the men were working on apparently makes steam to power other units at the plant. Occupational Health and Safety Administration (OSHA) http://www.osha.gov/ investigators and Valero officials are conducting a full investigation into the deadly refinery blast. It is currently unknown what exactly caused the explosion, or if anyone involved has obtained legal attorneys.

12/08/2009

Dallas, TX-This year has proved to be the deadliest year for child drownings in Texas. On Sunday, November 29, 2009, the 105th child passed away this year from a drowning-related accident. Top Dallas, Texas personal injury lawyer, Amy K. Witherite, urges parents to take the necessary steps to protect yourself and your loved ones from such tragic accidents.

The Houston Chronicle reported a 2-year-old Houston toddler, Joseph Enriquez, strayed away from a lunch barbeque hosted by the company his father works for as a mechanic, when the tragic accident occurred. After a frantic and desperate search the boy was found facedown in a 5-½ inch puddle of water. Enriquez's unfortunate death was the 105th fatality involving a child drowning in the state of Texas- the highest number of deaths since the state began documenting deaths in 2005. The Center for Disease Control and Prevention (CDC) http://www.cdc.gov/ released a set of guidelines designed to prevent your family from encountering such tragic and often fatal accidents:

•	Always have a responsible adult supervising young children who are in the bath, swimming, or playing near water.
•	The supervising adult should never engage in other distracting behavior while watching the children, like reading, talking on the phone, or mowing the grass.
•	Use the buddy system. Never swim alone, and have a lifeguard present, if possible.
•	Parents should teach their kids how to swim, and/or enroll them in swimming classes.
•	Air-filled toys or foam toys should never be used as a form of a life jacket, like "water wings" or "noodles." These toys were not designed to keep swimmers safe.
•	Install a four-sided pool isolation fence, which completely surrounds the pool and separates the house and the play area from the pool.
•	Always remove pool toys from the pool after use. The toys will entice young children to go near the pool, and possibly fall in.

Leading personal injury attorney, Amy Witherite, states by following necessary precautions and preventions you and your loved ones can potentially avoid fatal and life-altering drownings. If you or someone you love has been injured or killed by another person's negligence, failure to provide a safe pool environment and lack of prevention of such tragic water-related accidents, you maybe entitled to damages you deserve. Contacting a Texas personal injury attorney who is experienced in litigating premises liability and other preventable injury cases may help you and your family protect your legal rights and recover from your damages and injuries.

12/03/2009

Dallas, TX-Leading Dallas, Texas automobile accident lawyer, Amy Witherite, reports a fatal head-on collision that tragically left a little girl without her mother and grandmother. A total of three people were killed and three others were injured when a Hyundai SUV slammed head-on into a Honda Passport minivan on Friday morning, November 20, 2009, near Wylie, as reported by Dallas Morning News.

Around 10:07 a.m., the Texas Highway Patrol responded to a fatal accident on Highway 205, just south of Lavon Lake. A white Hyundai SUV reportedly was traveling northbound in rainy conditions, when police officials believe the SUV hydroplaned and veered into the oncoming traffic lanes. The SUV then slammed head-on into a white Honda Passport minivan. The impact of the collision was so severe that it completely knocked the engine block out of the Hyundai, and was discovered laying in the roadway. The occupants of the SUV, Tommie Chambers, 35, and Ariel Langford, 15, residents of Wylie, sustained non-life threatening injuries. Chambers and Langford were both transported by emergency medical services (EMS) teams to Plano Medical Center for treatment. The driver of the SUV, Andrea Dunn, 42, of Nevada, Texas; along with passengers, John Mcilvain, 76, and Margaret Mcilvain, 74, of Nevada, were tragically killed in the violent collision. A 4-year-old girl who was also traveling in the SUV sustained non-life threatening injures, and was taken to the Children's Medical Center Dallas for treatment by doctors and nurses. Texas Highway Patrol reported that all the deceased victims were wearing their seatbelts at the time. Police officials are conducting a full investigation into the fatal two-vehicle collision. If you or someone you love has been injured or killed because of another driver's carelessness you may be entitled to compensation for your injuries and damages. Contacting a Dallas automobile accident lawyer who is experienced in litigating accident claims may help you recover damages you deserve.

11/23/2009

Dallas, TX-- Amy K. Witherite, renowned Dallas, Texas bus accident lawyer, announces the U.S. Department of Transportation (DOT) http://www.dot.gov/ proposed tougher bus safety regulations designed to eliminate major safety problems on our roadways. The Motorcoach Safety Action Plan targets driver fatigue and inattention, vehicle rollover, occupant ejections and oversight of unsafe motorcoach carriers, which causes fatal crashes across the nation. The safety plan comes just after the release of the shocking report of last year's fatal Texas church bus crash, which left 17 people dead, and its inadequate safety inspections.

A Houston automotive shop, which inspected the bus before it crashed and killed 17 passengers on board on August 8, 2008 in Sherman, is accused of giving passing safety regulations without ever performing the inspections. The bus was carrying 55 Vietnamese-American passengers to a Catholic Retreat in Missouri, when they crashed soon after leaving Houston, as reported by the Dallas Morning News. Upon an inspection last month by the National Transportation Safety Board (NTSB) http://www.ntsb.gov/ they discovered the 5-Minute Inspections conducted at the Houston shop missed several safety issues just one week before the crash. The inspection failed to notice the unlawful tire retread and a puncture in the retread tire that led to the crash.

In the United States, 750 million people annually use buses as a form of travel. The National Highway Traffic Safety Administration (NHTSA) http://www.nhtsa.gov/ reports, on average 19 motorcoach passengers are victims of fatal crashes every year. The Motorcoach Safety Action Plan is designed to bring the statistics even lower; it has proposed to enhance regulatory oversight, and increased use of technology. New rules will prohibit texting and tighten the limitations on cellular telephone and other device usage by bus drivers. Electronic on-board recording devices will be installed to help oversee drivers' on-job hours to help address fatigue, and general oversight of unsafe buses. Installation of seat belts, stronger vehicle roofs, fire safety, emergency egress, and electronic stability control to help prevent rollovers will also be new features added under the proposed plan. Drivers and passengers on Texas roadways and highways depend on the safety and security of the passenger vehicles they travel in. Unfortunately, when routine safety inspections are inadequate or equipment on motorcoaches is defective or unsafe, the damages and injuries can be so severe they even cause death. Contacting a Texas bus accident attorney who is experienced in litigating preventable injury cases may help you and your family protect your legal rights and recover from your damages and injuries.

11/09/2009

Dallas, TX- Prominent Dallas 18-wheeler accident attorney reports a violent wreck on Highway 43 and Farm-to-Market Road 2625 left an 18-wheeler jackknifed on its side, and its driver trapped inside the severely damaged semi-truck. The Marshall News Messenger reported one man was injured in the Wednesday morning, November 4, 2009 crash.

Around 10:33 a.m., an 18-wheeler logging truck was reportedly traveling northbound towards Marshall on Highway 43, when the semi-truck slammed into another truck which was trying to cross several lanes of traffic on Farm-to-Market Road 2625. The 18-wheeler made desperate attempts to warn the other truck driver that he was approaching by blaring his horn and pumping his brakes, but his attempts were not successful. The logging truck tried to swerve but slammed into the crossing truck, which was described by witnesses as an "explosion." The logging truck came to a stop in a ditch with portions of the truck turned on its side. Witnesses rushed to the overturned semi-truck and discovered the driver was pinned by the steering wheel in the wreckage, with smoke quickly filling the cab. The source of the smoke was the tractor-trailer's radiator that was apparently damaged in the wreck. Witnesses were able to diffuse the smoke until firefighters arrived at the scene by breaking out the back window of the cab. The victim reportedly sustained lacerations to his face and complained of pain in his legs, in addition to having trouble breathing due to the smoke inhalation. Marshall Fire Department had to use hydraulic tools to extract the man from the wreckage before he was rushed by ambulance to the Level One Trauma Center at Good Shepard Medical Center in Longview. The driver of the eastbound truck reportedly did not sustain any major injuries. The Harrison County Sheriff's Office and District Two County Volunteer Fire Department all responded to the two-vehicle wreck. Texas Department of Public Safety (DPS) http://www.txdps.state.tx.us/ investigators are conducting a full investigation into the crash.

10/30/2009

The Dallas personal injury law firm of Eberstein & Witherite announced that Shelly T. Greco, an associate attorney with the long-standing Texas personal injury firm, has been named the 2009 recipient of the John Howie award. This prestigious honor, presented by the Dallas Trial Lawyers Association (DTLA), was bestowed upon Ms. Greco on October 22 in recognition of her courageous fight for justice for her Plainview client, Diane Brownlee, a Texas nurse who suffered permanent injury because of the wrongdoing of licensed health care professionals at Lubbock Heart Hospital.

The John Howie award is given to trial lawyers who pursue justice in the face of great adversity on behalf of a victim, regardless of the outcome of the legal action. In the spirit of John Howie, a former Dallas trial lawyer who spent more than 25 years fighting for the rights of victims facing countless obstacles until his untimely death in 2002, plaintiff's lawyers Shelly T. Greco and co-counsel Rachel E. Montes have been honored for keeping Howie's spirit alive. Ms. Greco, a compassionate litigator with the Dallas personal injury firm, Eberstein & Witherite, overcame countless hurdles in her fight to recover compensation for Diane Brownlee for the permanent injuries and damages she suffered.

In the case of Diane Brownlee v. Walter C. Brogan III, M.D.; Lubbock Heart Hospital; and Denise Rodella, R.N., #2007-539760; Greco fought tirelessly against a hospital, the conservative 99th District Court in Lubbock County, Texas, and overcame the prejudices of the community to obtain justice for Diane Brownlee. On June 27, 2005, Dr. Brogan and Nurse Rodella failed to treat loss of blood supply and circulation to Brownlee's right leg that was caused by Dr. Brogan's negligent care after she underwent an angiogram, also known as a cardiac catheterization, for chest pain. Nurse Rodella recognized the emergent symptoms of a pale, cool, pulseless leg while caring for Brownlee in the post-operative recovery room and informed Dr. Brogan. The physician failed to address the increasingly traumatic symptoms and ordered Ms. Brownlee to be discharged the same day of the cardiac catheterization. In spite of the worsening symptoms of the patient's leg, Nurse Rodella, whose shift was ending, failed to advocate for her fellow nurse and patient, Brownlee, and sent her home. Brownlee underwent emergency surgery the following day and unfortunately suffered permanent nerve damage. The injured nurse continues to experience chronic right leg pain and is no longer able to work as an emergency room nurse or participate in her life's work of providing bedside patient care, that she began as a nurse's aid at the age of 13.

Lubbock County is considered the "health care" county, as the largest employer of doctors, nurses, and health care staff in Texas and is often biased accordingly. The main argument by the defense attorney was the patient, Brownlee, should have known her symptoms were a medical emergency and refused to leave Lubbock Heart Hospital on June 27, 2005. The defense contended the patient should have known to seek immediate medical attention the same day of her procedure and discharge. The patient followed Dr. Brogan and Nurse Rodella's instructions and went home to rest for the night. The treating hospital, doctor, and nurse actually blamed the patient for their own failure to treat plus their own violations of national standards of care.

The medical malpractice trial covered 10 days with the jury returning a $434,238.05 verdict for the following damages: past medical and future medical damages; past pain and mental anguish; future pain and mental anguish; past and future impairment. Congratulations to the to lead personal injury attorney Shelly Greco and her top legal team for obtaining compensation and justice for their client.

Dallas car wreck lawyer educates Texas drivers about using emergency care in automobile accidents into water.

Dallas car wreck lawyer, Shelly T. Greco, an attorney who handles personal injury claims throughout Texas alerts two motor vehicles fell 20 feet and landed upside down in the bottom of Five Mile Creek on Sunday, October 11, 2009. As reported by the Dallas Morning News, Urban Search and Rescue Teams from Oak Hill and East Dallas, plus Dallas Fire Rescue teams, received calls that two automobiles crashed, went off road at Holiday Drive in the 3400 block, and fell 20 feet to the bottom of Five Mile Creek at noon on Sunday. Two victims were extricated from one of the wrecked cars and a woman with two children from one of the two autos were ambulatory at scene of the accident when Dallas County area emergency medical rescue crews arrived. Neither of the motor vehicles were submerged in water, and all five victims involved in the two car crash were transported to Methodist Medical Center for treatment of their injuries.

Shelly Greco, a skilled Dallas automobile accident lawyer, says thankfully the motor vehicles involved in the car wreck on Sunday were not submerged in water, and all five of the victims were taken to the hospital so they could receive emergency care for their injuries. Greco, a Dallas personal injury attorney, educates Texas drivers and passengers on what to do if they are involved in an automobile accident and find themselves in a car that has landed in water.

-Immediately unfasten your seatbelt

-Immediately roll down your windows before water reaches window height

-If water is at window height, slowly roll down the windows and let water

flood the car

-Swim out of automobile

When cars wreck, drivers and passengers typically suffer some type of injury. Automobile accidents can also kill drivers and passengers. When motor vehicles collide and then land in water, the potential for more serious injury and death increases exponentially because the immediate concern of drowning is at hand. Dallas car wreck attorney, Greco, urges all Texans to educate themselves on the above immediate actions to be taken if their car lands in water.

10/05/2009

Texas product liability attorney alerts Toyota Motor Corp accused of destroying key car crash evidence material.

Texas product liability lawyer, Amy K. Witherite, a personal injury attorney headquartered in Dallas and experienced in car crash cases, alerts drivers a U.S. judge ordered Toyota to preserve all documents pertaining to “crashworthiness” of the auto maker’s motor vehicles. U.S. District Judge T. John Ward in Marshall, Texas, handed down his order on September 30, 2009, after reviewing evidence presented to him from another lawsuit against Toyota, as reported by Bloomberg. Apparently a former in-house attorney for Toyota filed a federal lawsuit, in July in Los Angeles, against the automobile manufacturer, claiming Toyota destroyed documents which should have been preserved and presented in personal injury and product liability court cases.

According to court documents, in the case of Lopez v. Toyota Motor Corp., 2:09CV292, U.S. District Court, Eastern District of Texas (Marshall), a Dallas area product liability attorney asked Judge Ward’s permission to reopen lawsuits representing injured victims, his clients, who had previously resolved their product injury claims with Toyota or had their cases dismissed. The product liability attorney representing clients, such as family members of drivers and passengers who died in car crashes because of product defects, requested the reopening of his client’s suits after learning of the allegations in the California lawsuit. Texas Justice Ward wrote in his ruling, “The court finds an immediate threat of irreparable harm in that, under the allegations, a threat exists that evidence material to this case would be destroyed or altered.”

The previous product liability lawsuits involved people who were killed or suffered permanent injuries, like paralysis. Many of the injured victim’s claims were dropped because of lack of evidence. Toyota company leaders claim they have acted appropriately and the former in-house attorney, Dimitrios Biller, says he suffered a mental breakdown. The previous litigator for the automobile manufacturer alleges he was unable to continue his work as legal counsel for the company because he was continuously required to perform unethical and illegal tasks. The California federal lawsuit filed in July by attorneys representing Biller assert the former employee was forced to resign in 2007. Biller received $3.7 million in a lawsuit settlement agreement with the company. Under the Texas court order Toyota, any of its entities, employees, and legal counsel must maintain the integrity of all documents and materials relating to product liability and/or crashworthiness of motor vehicles manufactured by the automaker.

Drivers and passengers on Texas roadways and highways depend on the safety and security of their automobiles. Unfortunately, when a routine safety feature on a motor vehicle is defective the damages and injuries can be so severe they even cause death. Texans and their families pay the cost of defective automobile every day. Contacting a Texas product injury attorney who is experienced in litigating preventable injury cases involving bad auto parts and safety equipment may help you and your family protect your legal rights and recover from your damages and injuries.
